1. Acceptance of Terms

By accessing or using the BookedSolid Pro platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

BookedSolid Pro provides a self-serve platform for purchasing homeowner and consumer lead lists compiled from public and proprietary data sources. Lead lists include contact information, demographic data, property information, and other data points as described on our website.

3. Account Registration

To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Permitted Use

You agree to use the data obtained through BookedSolid Pro only for lawful business purposes, including but not limited to direct marketing, telemarketing, direct mail, and customer acquisition. You agree NOT to:

  • Use the data for any unlawful purpose or in violation of any applicable law or regulation.
  • Resell, redistribute, or sublicense raw data files without prior written authorization.
  • Use the data to harass, threaten, or defraud any individual.
  • Use the data in any manner that violates the privacy rights of any individual.
  • Use the data to discriminate against any individual on the basis of race, color, religion, sex, national origin, disability, or any other protected class.

5. DNC & Telemarketing Compliance

You are solely responsible for compliance with all applicable telemarketing laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), the Federal Trade Commission's Telemarketing Sales Rule (TSR), and all federal and state Do Not Call (DNC) regulations.

While BookedSolid Pro provides DNC status as a courtesy data point in each record, we make no guarantees regarding the accuracy or completeness of DNC status data. It is your obligation to independently verify phone numbers against the National Do Not Call Registry and any applicable state DNC lists before initiating any telemarketing calls.

BookedSolid Pro shall not be liable for any fines, penalties, or damages arising from your failure to comply with DNC or telemarketing regulations.

6. Data Accuracy & Warranty Disclaimer

While we strive to maintain accurate and up-to-date records, all data is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or accuracy. Data records may contain outdated, incomplete, or inaccurate information.

7. Replacement Guarantee

BookedSolid Pro offers free replacements for disconnected or wrong phone numbers at no additional charge. To request replacements, submit a list of affected records through our platform or contact us at hello@bookedsolidpro.com. Replacement eligibility is determined at our sole discretion.

8. Payment & Refunds

All purchases are final. Due to the nature of digital data products, we do not offer refunds on purchased lead lists. The Replacement Guarantee (Section 7) is the sole remedy for data quality issues.

9. Limitation of Liability

To the maximum extent permitted by law, BookedSolid Pro and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service or any data obtained through the Service.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid to BookedSolid Pro in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless BookedSolid Pro and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms or suspected unlawful use of our data.

12. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify you of material changes by posting the updated Terms on this page.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law provisions.
